Η ένδικη διαφορά ξεκίνησε ύστερα από την έκδοση της υπ’ αριθμ. 2185/2019, ήδη αμετάκλητης απόφασης του Μονομελούς Πρωτοδικείου Αθηνών δυνάμει της οποίας αναγνωρίστηκε ότι οι αλλεπάλληλες συμβάσεις ορισμένου χρόνου εργαζόμενης απασχολούμενης στον Φορέα Κοινωνικής Προστασίας και Παιδείας του Δήμου Παιανίας υποκρύπτουν στην πραγματικότητα μια ενιαία σύμβαση αορίστου χρόνου, υποχρεώνοντας τον Φορέα να αποδέχεται τις προσηκόντως προσφερόμενες υπηρεσίες της υπαλλήλου και να την απασχολεί στη θέση, ειδικότητα και με τις αποδοχές που αντιστοιχούν στην υπηρεσιακή ένταξη και εξέλιξή της, λαμβανομένων υπόψη και των λοιπών τυπικών προσόντων της. Το ΝΠΔΔ συμμορφώθηκε εν μέρει με την ως άνω αμετάκλητη δικαστική απόφαση καθώς προχώρησε, μεν στην σύσταση προσωποπαγούς θέσης αορίστου χρόνου κατατάσσοντάς την δε στο χαμηλότερο Μισθολογικό Κλιμάκιο (ΜΚ1) έως και τον Οκτώβριο του έτους 2020, οπότε και συμμορφώθηκε πλήρως με την ως άνω απόφαση και την ενέταξε στο ορθό 7ο Μισθολογικό Κλιμάκιο (ΜΚ7) της κατηγορίας Δ.Ε.
Δυνάμει της υπ’ αριθμ. 15/2023 οριστικής απόφασης του Ειρηνοδικείου Αθηνών κατά τη διαδικασία Περιουσιακών – Εργατικών Διαφορών όπως αυτή η απόφαση διορθώθηκε δυνάμει της υπ’ αριθμ. 103/2023 απόφασης του ιδίου Δικαστηρίου, έγινε δεκτή η αγωγή της υπαλλήλου του Φορέα Κοινωνικής Προστασίας και Παιδείας Δήμου Παιανίας επιδικάζοντας σε αυτή ως διαφορά των νόμιμων αποδοχών της για το επίδικο διάστημα από την 1.1.2018 έως και την 31.10.2020, το ποσό που αντιστοιχεί στη διαφορά των αποδοχών της λόγω της κατάταξής της σε χαμηλότερο από το αναλογούν μισθολογικό κλιμάκιο, με το νόμιμο τόκο από την επίδοση της αγωγής μέχρι την εξόφληση, καθώς και χρηματική ικανοποίηση λόγω ηθικής βλάβης που υπέστη.
